Updated terms and conditions – January 2021

We have updated our terms and conditions. The new terms and conditions will be in effect from January 1, 2021 and will apply to all new and additional orders placed from that date forward. The previous version of the terms and conditions (last changed in October 2017) can be found here and still apply to all orders that were placed before January 1, 2021.

In this post we will summarize the changes we made and why those terms were changed. You can read the full terms and conditions here.

Policy change regarding cancelation of backordered items

We updated our policy on how we deal with the cancelations of backordered items. We used to allow the cancelation of all backordered products. Now we will only allow such cancelations when the backordered product doesn’t have a paid reservation or when it has been on backorder for more than 2 weeks.

Backorders are quite common for Korean brands, since they operate with a minimum amount of stock (to reduce the need for capital and limit stock risk) and are set-up to quickly manufacture new stock if needed (usually with 2 weeks). Our collaboration with the Korean brands keeps improving, so they are now often offering us an extra service where they accept a paid reservation on new stock. This paid reservation assures us that we can get the products as soon as they are restocked by the brand. Without the paid reservations we need to recheck again (and sometimes several times) for new stock, which is quite some extra work, and we might miss out when the new stock sells out again. But with the paid reservation we will automatically receive the products when they are ready and don’t have to worry about missing out. So the paid reservations offer a big advantage, but they are also a commitment.

Frequent cancellations of the paid reservations have proven to be problematic for us and the brands to the point where some brands were considering to no longer offering that service at all. To be able to keep making paid reservations we had to limit the possibility to cancel products with such reservations.

This means that the fulfillment of orders can take up to about 2 weeks when part of the order is on backorder with a paid reservation. We are already offering the option to all buyers to split their order into two shipments. The first part will then be shipped right away and will include all the readily available products. And the second part will be shipped when the rest of your order is ready. For this option we charge max. $10.52 extra on the shipping cost. But from now on buyers with an order over $2,103.40 will not be charged any additional shipping cost at all for this service. You can read more about split shipments here.

Changes per article:

Below we summarize the changes per article.

Article 1:

  • We removed all mention of www.kfashion.kkami.nl. For a while we operated a second website (www.kfashion.kkami.nl) for woman fashion wholesale. That website is no longer in use. So we removed all mention of that website and specific requirements related to that site from the terms and conditions.
  • We added text to clarify that we may agree to different terms with you and that in that case other parts of the terms and conditions will remain in full effect. This helps us to better cover common exceptions to the minimum order requirement for sample orders and cases where buyers place small additional orders to add to their original order or to replace unavailable parts of their original order.

  • We removed all mention of www.kfashion.kkami.nl and removed the specific order requirements related to the www.kfashion.kkami.nl site.
  • We removed the requirement that for clothing and shoes you are required to order a minimum of 3 different sizes for each color that you want to order. That requirement was intended to make sure that each order had sufficient wholesale characteristics. But in practice it was hard to check each incoming order on this point and some resellers found it too restrictive. So instead we specified in other terms (in Article 7) that we may cancel the order when we suspect the order is not intended for reselling.
  • We clarified the currency, since the currency symbol alone might not be clear enough to everybody.

Article 4:

Article 5:

  • We generalized the passage about our bank account since we not only use Korean bank accounts to accept bank transfers, but also use bank accounts in other countries.

Article 6:

  • No changes, except for small textual improvements.

Article 7:

  • We changed paragraph 5 to reflect the policy change regarding cancelation of backordered items (as discussed at the beginning of this post).
  • Part of the original paragraph 5 was added as a new paragraph 6 and the following paragraphs were renumbered.

Article 8:

  • No changes were made to this article.

In addition to these changes we made several smaller textual improvements that were only intended to improve the quality of the text but did not change its meaning.
